- Abstract
Rapid development of the global medical aesthetics industry. Its two core attributes, medical and consumer, give rise to the dilemma of legal application and supervision. This article focuses on the contradiction between the lagging legal supervision and the growing demand in this field. Based on case analysis and comparative research methods, the core characteristics of medical attributes (specialized medical techniques and the risk of permanent damage to health) and primary performance forms of consumer attributes (paid services for aesthetic needs and demands for fair transactions) are expounded; then, through case analysis, the existing practical difficulties in legal supervision are summarized: contradiction between medical norms and consumer protection laws, segmentation of supervision systems, and imbalance of dispute resolution mechanisms; finally, targeted improvement ideas are put forward: building a supervision concept of medical safety and consumer fairness, differentiated supervision according to risks, and cross-departmental collaborative supervision and multi-dimensional dispute resolution. The research is expected to provide relevant theoretical support for medical aesthetics disputes and the protection of the legitimate rights and interests of aesthetic subjects.
