- Abstract
The development of medical informatization has made medical data a crucial driving force for advancing medical research and improving diagnostic accuracy. However, this process has also witnessed frequent information security incidents, resulting in severe infringement of personal information privacy. This not only hinders the legal application of data but also exposes significant loopholes in the regulatory system. This paper aims to deeply explore the urgent challenges faced by personal information protection and effective legal supervision in the context of medical data sharing. The research employed various research methods such as literature synthesis analysis, comparison of domestic and foreign regulations, and case analysis to conduct a detailed analysis of legal dispute focuses. The research conclusion emphasizes that any data sharing mechanism should be based on the privacy rights guaranteed by the constitution and the principle of information autonomy. To achieve a balance between data utilization and protection, it is urgently necessary to establish a clear legal framework, strengthen the legal responsibilities of data processors, improve the channels for individual rights protection, and build a detailed regulatory framework based on risk levels. This study provides a more comprehensive and in-depth perspective for optimizing the legal regulatory environment for medical data sharing.
