Abstract

As China’s society enters the “digital age,” digital technology and network services have become essential to most Chinese people’s everyday lives. However, the legacy of “digital heritage” has also given rise to an increasing number of controversies. Since “digital inheritance” is hard to define and encompasses a wide range of topics, including law, technology, ethics, and more, Chinese courts frequently refrain from considering such cases because they are “not filing” or “inadmissible.” The primary cause is the difficulty in defining “digital heritage,” which encompasses a wide range of levels, including technology, ethics, and law, and the lack of clarity surrounding its legal features. The fundamental characteristics of digital heritage are virtual, private, and agreement-based, according to this paper’s analysis of its meaning and extension. Because of the intricacy of these features, the law must consider the dynamic balance between property and personal rights when defining and safeguarding digital heritage.
