Abstract

In Generative Artificial Intelligence (AI) represents a significant advancement in modern technology, yet there are currently no clear legal provisions regarding its nature and copyright attribution. International treaties and foreign legal precedents have suggested that generative creations can be recognized as works. An analysis of China's Copyright Law and relevant judicial practices reveals that for a generative object to qualify as a work, it must meet certain criteria: it should be an intellectual achievement in literature, art, or science; it must be expressed in a specific form; and it needs to demonstrate originality. Although AI technology plays a role in the creation process, it remains user-directed, meaning that the generated object reflects the author's thoughts. As a result, copyright should be attributed to the user. Furthermore, we can enhance the copyright attribution system for generative objects by strengthening the rules for confirming rights, establishing an additional management system, and clarifying responsibilities for infringement.
