Abstract

Corporate crime is increasingly complex as corporations dominate national economic activities. A notable case involves alleged cooking oil distribution violations by Musim Mas, Wilmar, and Permata Hijau Groups. This study examines judicial considerations in these cases and explores corporate criminal liability under Indonesian law. This study seeks to answer the following research questions: (1) How do judges construct and impose criminal liability on corporations in economic crime cases? and (2) What legal doctrines are applied in determining corporate criminal liability in cooking oil corruption cases? This study applies a normative legal method with case-based and statutory approaches, drawing on court decisions, legislation, and corporate criminal law doctrine. The findings show that judges emphasized executives’ roles and corporate structures in unlawful acts, consistent with strict liability, identification theory, and corporate mens rea. Sanctions focused on fines and corrective measures rather than imprisonment, as provided in Law No. 8/1999 and the Criminal Code. The study contributes a doctrinal and case-based analysis to support more consistent jurisprudence and regulation of corporate criminal liability in Indonesia.
