- Abstract
Development projects for public interest typically require land acquisition. Land in any conditions can be acquired for such purpose, including land situated in extreme conditions, e.g. destroyed land. This type of land has physically changed in its form to the extent that it is unidentifiable and unusable due to natural disasters or environmental changes. This article aims to analyse the resolution of compensation for destroyed land required for public interest development. This study employs a normative legal research method, utilizing statutory and conceptual approaches, through the case study of a public interest development project carried out by the government, namely the construction of the Semarang–Demak Toll Road, located between the City of Semarang and Demak Regency. The findings indicate that certain communities have not yet receive compensation funds (kerohiman) as a form of social impact settlement, and the state must guarantee the rights of all its citizens. This delay is primarily due to unresolved disputes over land ownership. The current regulations on social impact management do not provide provisions for compensation related to land under ownership dispute. This research recommends that the government should regulate a clear mechanism and procedure for compensating communities involved in land ownership disputes, especially when the land will be categorized as “destroyed”. These regulations are essential to guarantee legal certainty, justice, and public welfare for the affected populations.
