Abstract

Sustainable development and decent governance in Indonesia continue to be significantly impeded by corruption. Until now, law enforcement has prioritized a punitive strategy, while prevention strategies, notably those implemented by law enforcement agencies, have garnered more attention. This research aims to reconstruct the concept of legal assistance provided by the Prosecutor’s Office in the context of development implementation, particularly emphasizing its preventive function against corruption. This study investigates the duties and functions of the Prosecutor’s Office as they are regulated in laws and regulations, with a particular emphasis on the corruption prevention mechanism established by the Corruption Eradication Law through normative legal methods and legislative, conceptual, and comparative approaches. The study’s findings suggest that the current legal framework fails to adequately govern the scope and authority of prosecutors in delivering legal support during the planning and implementation of development projects. The Prosecutor’s preventive function is not yet optimal, and this legal lacuna raises institutional doubts. Additionally, inconsistent practices are present. The Prosecutor’s office has the potential to play a more proactive and structured role in ensuring the use of public funds, as evidenced by comparative studies conducted in numerous countries. Consequently, this investigation suggests a legal reconstruction that explicitly incorporates legal assistance into the core responsibilities of the Prosecutor’s Office, bolstered by transparent regulations, interagency coordination, and accountability standards. It is hoped that reconstructing the Attorney General’s Office’s preventive role through proactive legal assistance can create a law enforcement system that is not only repressive but also solution-oriented and prevention-oriented.
