Abstract

The concept of including environmental losses in the scope of state financial losses is a theoretical reality that needs to be proven clearly because if natural resources are managed using inappropriate permits and there are procedural errors, it will result in the state losing its right to manage state assets. This research aims to analyze how environmental damage can be considered a financial loss for the state, particularly in cases of corruption-related criminal acts. This research employs a doctrinal legal approach, utilizing statutes and case study to design the legal framework for proving environmental damage in corruption cases, which includes identifying state losses. This research shows, first, that legal arguments are needed that environmental damage is an element that is detrimental to state finances, especially in cases of corruption. Second, the legal construction of evidence of environmental damage is carried out by classifying environmental losses as state losses in derivative regulations to achieve legal certainty. Thus, the first problem will be resolved by determining specific regulatory recommendations that show that environmental damage is a state financial loss so that legal benefits, certainty, and justice can be achieved.
