Abstract

This article seeks to reconstruct the regulatory framework, specifically by emphasizing the principle of notarial prudence when issuing covernotes. This emphasis serves as a crucial preventive measure against unlawful acts during the binding of banking credit agreements. To measure the utility of a new, integrated structure, we applied the LETHEI approach—Legal, Economic, Technological, Human, Environmental, and Institutional—a model uniquely suited for analyzing systemic weaknesses, reducing legal uncertainty, and addressing inconsistencies in practice. The complex challenges of this study were observed in Belu Regency, East Nusa Tenggara, Indonesia, a region representative of underdeveloped areas facing multifaceted problems. Our methodology employed a Mixed Methods Analysis and the support of Multicriteria Policy Analysis software. Data were obtained through field studies at the National Land Agency Office and in-depth interviews with expert informants, including Notaries, Bank Officials, Customers, Policy Stakeholders, and Legal Experts. To support the argument, this article also discusses the concepts of natural law, legal certainty, and virtue ethics based on notarial covernote practices and relates them to policies in other countries. The results show that Legal—Restruct obtained an average score of 18.9, followed by Technology—Notary Cyber and Human—Integrity with a score of 18, as the most dominant strategies. The LETHEI framework is used not only in analyzing policies but also in designing policy designs based on a holistic, collaborative, and anticipatory approach.
