Abstract

International trade often experiences crises, one of which has occurred since 2023 due to a crisis in the Red Sea that arose due to the Houthi group’s attack on commercial shipping ships until it was finally forced to avoid the Red Sea and the Suez Canal as its shipping route. This has an impact on the shipping industry and global business, especially regarding the legal aspects of shipping insurance. There was an increase in insurance costs from 0.1% to 2% of the value of the ship, after the attack on Maersk’s cargo ship that occurred in 2023. The analysis in this scientific article will focus on the application of the marine war risk clause in shipping insurance due to the crisis in the Red Sea which is classified as a force majeure situation based on the perspective of shipping insurance law, reviewed through a normative juridical approach by examining international regulations, namely the Marine Insurance Act 1906 (MIA 1906) related to international shipping law. The study of this scientific article shows that there is an urgency to update the shipping insurance clause, especially in terms of dealing with crises that occur from an international trade perspective, especially in dealing with geopolitical risks arising from armed conflict crisis.
