Abstract

The process of artificial intelligence (AI) is impacting our lives, work and socialization with each other at a very rapid pace. The AI has broken the conventional copyright structures producing ethical and legal issues regarding Intellectual Property (IP) Rights. The emergence of AI has brought forth intricate issues especially in terms of the production, consumption and the right to AI-generated material. This created a desire of a comparative study that adopts this intersection and investigates the different legal frameworks that govern IP rights and AI in various countries. The study article used the comparative research methodology by reviewing ethical and legal principles that controlling the interplay of IP rights and AI in India and the United States of America. This paper identifies the similarities in the way apex courts in both countries have addressed AI-related copyright issues over the past few years, as part of its analysis of the similarities. The paper proposes a universal re-definite of the copyright laws to fit the emerging issues of AI so that there is a balance between innovation and safeguarding the rights of the creator.
