Abstract

In this paper we cater to hard questions surrounding Intellectual Property (IP) protection and Artificial Intelligence evolution at the same time. Firstly, there is a need to carefully demystify several IP protection measures adopted by EU, USA, UK under respective AI governance policy. How far have they reached in figuring out IP issues in congruence with generative AI models? A comparative study goes a long way in comprehending the underlying nuances, so as to provide a vision for policy making in India. In addition to it, case studies across several jurisdictions, in which judiciary has taken a clear stance, has been briefly discussed. In the end, we attempt to lay down a framework for comprehensive AI policy. It all might seem too much too soon, keeping that in mind, the authors have come up with a list of suggestions for policymakers and professionals who work at crossroads of AI and IP law.
