- Abstract
In the current era of technology advancements permeating nearly every aspect of life, personal data is an asset that, with the correct knowledge, can be transferred without rights for both legitimate purposes and illegal purposes. The banking sector is now dealing with a number of issues related to client data leaks. The purpose of this article is to investigate the concepts of bank secrecy and prudence in the event that client data from the banking sector is compromised. This paper employs a kind of normative research that combines a conceptual and legislative approach. In order to address the set of concerns, primary and secondary legal sources are gathered and qualitative analysis techniques are applied. The findings and discussion revealed that, according to current regulations, the bank confidentiality principle offers customers who are outraged about the leak of their personal data both preventive and repressive legal protection, while the bank prudential principle has only been applied in favor of bank interests thus far.
