Abstract

The number of drug cases has increased compared to other traditional crimes. According to the Corrections Directorate General, as of 2021, 96% of prisons are filled with drug offenders. Drug-related crimes involve individuals of various ages, from adults to children. Juveniles are often coerced or manipulated into becoming victims of drug use and trafficking. Additionally, the application of criminal sanctions and sentencing is similar for both adults and children, with little focus on rehabilitating child drug offenders. Despite laws under Laws pertaining to juvenile criminal justice and child protection stating that children should receive reduced sentences and non-penal measures, in some drug cases, children receive minimum sentences and are imprisoned for years, especially if convicted for drug-related offenses. A study examines the considerations made by judges when dealing with four (4) drug offenses committed by child offenders, such as drug mules.
