- Abstract
Indonesia as the biggest archipelagic states, currently positioned as one of the countries most affected and vulnerable to climate change. While the climate change occurs globally, the impact of climate hazard is not equally distributed between men, women, girls, boys, indigenous women and gender minorities. Climate change puts women and girls at greater risks and thus, law reforms play a pivotal roles in addressing gender disparities by ensuring that policies and regulation are inclusive and effectively address unique challenge faced by women. Despite progress on laws reforms towards gender parity, there are still gaps in regulation for guaranteeing women’s rights in the era of climate change such as lack of recognition for inclusion in decision making on environmental governance, gender-specific health needs during disaster and climate crisis, inequal rights for land and property ownership, etc. This paper aims to understand the nexus of gender and climate change, also providing recommendations to accelerate law reforms that ensure the policies and regulations can guarantee women’s health rights, access to resources, and strengthen women protection measures in disaster prone-areas. This paper uses normative legal research which involves examines the norms, principles and values that underlie regulations, aiming to provide a framework that supports better law making and legal reform using a comprehensive and structured search for literature on a specific legal topic. The result of this research is that there is an interrelation between gender in the context of climate change and accelerating law reforms by integrating gender considerations into climate and environment law will ensure that policies are more equitable and inclusive, resulting in more sustainable and just outcomes.
