Abstract

The abuse of artificial intelligence face-changing technology (Deepfake) constitutes a new type of criminal offense, seriously infringing upon citizens’ portrait rights, reputation rights and privacy rights, and posing a structural challenge to the current criminal law system. This paper, through case analysis and international comparative studies, points out that AI face-swapping crimes have significant difficulties in terms of subject determination, evidential force and cross-border accountability. Based on this, a multi-dimensional governance framework centered on “technology - law – society” is proposed, emphasizing the synergy of dynamic legislation, platform responsibility and public education, and providing an operational regulatory path for law enforcement agencies and policymakers.
