Abstract

An authentic deed holds a high evidentiary value; however, in practice, notarial deeds are sometimes annulled by the court due to legal defects. One such annulment occurred in Decision Number 75/Pdt.G/ 2006/PN.Mdn, which invalidated the Deed of Sale and Purchase Agreement and the Deed of Release of Rights over a house and land. This research examines the legal standing of a deed of agreement made before a Notary, the judge’s considerations in Decision Number 75/Pdt.G/2006/ PN.Mdn regarding the annulment of a notarial deed, and the legal consequences of annulling a deed of agreement made before a Notary. The method used is normative juridical, employing a statutory approach and a case approach. Data were obtained through literature studies on legislation, legal doctrines, and court decisions. The results indicate that although a notarial deed meets the elements stipulated in Article 1320 of the Indonesian Civil Code, it can still be annulled if proven to violate objective requirements or contain legal defects. Suc annulment results in the loss of binding force and legal protection originally guaranteed by the deed and may cause losses to one of the parties. Therefore, Notaries must exercise greater caution and thoroughness in drafting deeds to prevent future legal disputes.
