- Abstract
This study examines the licensing system for drug trafficking in Indonesia and the legal responsibility of individuals involved in counterfeit drug distribution, with a focus on the case of Decision Number 129/Pid.Sus/2023/PN.Pal concerning the drug Trihexyphenidyl. The objective of the research is to analyze the regulations governing drug trafficking, the mechanisms of government supervision, and the forms of legal accountability for perpetrators of pharmaceutical crimes. The research employs a normative juridical approach combined with case study analysis. The findings indicate that drug circulation in Indonesia is tightly regulated through various laws, including Health Law No. 36 of 2009, the Consumer Protection Law, and regulations issued by BPOM. In the Trihexyphenidyl case, the offender received both imprisonment and fines for violating health and consumer protection regulations. The government has undertaken multiple measures to combat counterfeit drug circulation, including strengthening regulations, supervising distribution, enforcing the law, and utilizing digital technologies. Despite these efforts, challenges persist, originating from internal factors such as weak supervision and regulatory gaps, as well as external factors, including limited international cooperation in addressing drug counterfeiting. The study recommends the creation of a dedicated law on drug counterfeiting and enhanced coordination among relevant agencies to improve public protection against the risks posed by counterfeit pharmaceuticals.
