Abstract

The village head election is the most basic and real application of democracy in the community through the principle of one man one vote that the village community realizes a collective agreement to determine the fate of the people themselves, of course as the first spearhead of national democracy in strengthening the local government system and the central government, but the village head election process is utilized by oknom or a group of people to become a gambling arena which results in the destruction of the spirit of the village head election itself. The formulation of the problem taken in this research is how the practice, implications and resolution of gambling violations in the process of organizing village head elections, the purpose of the research is to analyze the practice of gambling in village head elections, while the research method used is normative research method with case and legislative approaches, While the results of the study show that the practice of gambling in the village head election fulfills the elements of gambling in the Criminal Code, the implications of gambling practices in the village head election do not provide satisfaction with the results of the village head election because there is a process that has the potential for bribery from gambling players to voters of prospective village heads, while the solution is the method of law enforcement and legal awareness education to gambling players.
