- Abstract
This article investigates the interplay between data privacy, Big Data, and public health within the framework of Indonesian legislation, specifically focusing on the implications of the Health Law and the Personal Data Protection Law. This analysis elucidates the paramount importance of managing patient data in accordance with legal standards while ensuring the safeguarding of personal information in the era of Big Data analytics. The discussion delineates the rights of data subjects, emphasizing their capacity to pursue redress through established dispute resolution mechanisms outlined in the Personal Data Protection Law. Furthermore, the paper examines the obligations of healthcare providers in protecting personal data amidst the challenges posed by Big Data utilization and the potential legal ramifications of non-compliance. Through a comprehensive review of case studies and contemporary practices, this article aims to elucidate the challenges and opportunities inherent in the implementation of effective data privacy measures within the healthcare sector. Ultimately, this analysis advocates for a balanced approach that fosters innovation in public health through Big Data while concurrently upholding the fundamental rights of individuals regarding their personal data.
