Abstract

In article explores the legal framework surrounding intellectual property (IP) within the country, outlining its development and significance. Intellectual property law in Azerbaijan is heavily influenced by international agreements, such as the 1967 WIPO Convention and the 1995 TRIPS Agreement, which shaped the global standards for IP protection. These agreements introduced IP as a distinct legal domain covering areas such as copyrights, patents, trademarks, industrial designs, and geographical indications. Azerbaijan’s Civil Code incorporates intellectual property as a subfield of civil law, emphasizing the legal rights associated with the results of creative activities, including both personal and property rights. The document elaborates on copyright law as a critical sub-institute of intellectual property, explaining the rights and protections granted to authors and creators under the Law on Copyright and Related Rights. It also discusses key principles such as the recognition of authorship, the inviolability of works, and free use under certain conditions. Furthermore, the document highlights the legislative framework regulating IP in Azerbaijan, referencing additional laws like the Law on Advertising, Law on Culture, and Law on Media, all of which play roles in protecting IP rights in their respective fields. Overall, the document underscores the importance of IP law as a key subfield of civil law, ensuring the protection and use of creative works within the country.
