Influence on Claims Management and Alternative Dispute Resolution of the Ghanaian Construction Industry

Abstract

This study investigates the impact of claims management on sustainable practices in Ghana’s construction industry, examining how efficient dispute resolution influences project performance and the integration of environmentally responsible practices. Quantitative survey was conducted with 111 construction professionals, including engineers, project managers, contractors, quantity surveyors, and architects. Data were analysed using descriptive statistics, correlation analysis, and one-sample t-tests to explore the relationship between claims management, Alternative Dispute Resolution (ADR), technology adoption, and sustainability outcomes. Ineffective claims management was found to contribute to cost overruns, delays, rework, and resource wastage, while structured practices, particularly through ADR and digital tools such as Building Information Modelling (BIM) and Artificial Intelligence (AI), enhanced timely resolution, resource efficiency, and sustainability integration. Correlation analysis revealed significant positive relationships between claims management, ADR adoption, technology use, and sustainable construction practices. One-sample t-test results further confirmed strong industry support for strategies such as wider ADR adoption, professional training, early claim detection, and the establishment of a standardised national framework for claims resolution. Key barriers included regulatory gaps, contractual ambiguities, and limited adoption of technology. The study underscores the necessity for a national claims management framework, enhanced regulatory enforcement, stakeholder education, and increased adoption of digital technologies to strengthen claims resolution and promote sustainable construction outcomes. This is one of the first empirical studies in Ghana to statistically demonstrate the link between claims management and sustainability through correlation and strategy validation. It provides practical strategies for contractors, consultants, and policymakers to align dispute resolution with Sustainable Development Goals (SDG 9 and SDG 11).
