- Abstract
Due to the fast paced growth of the international shipping industry, marine ecosystems and coastal nations are being challenged by the issue of oil contamination from ships. A worldwide legal system has been created in accordance with international law principles, which is centered on the triple jurisdiction of flag states, coastal states, and port states. This system has established a dual compensation mechanism comprising shipowner liability, compulsory insurance, and compensation funds. In the current year, China has established an oil pollution prevention system, encompassing multiple laws and regulations, and has participated actively in relevant international conventions. Nevertheless, challenges persist, encompassing fragmented provisions within the prevailing legal framework, inadequate compensation fund mechanisms, and the dearth of ecological value assessment. In order to achieve effective alignment with international rules, it is imperative to advance specialised legislation, systematically integrate existing institutional resources, and refine the fund compensation structure. Concurrently, the introduction of an ecological value assessment mechanism has the potential to enhance China’s legal standards for oil contamination prevention and damage compensation in shipping.
