Abstract

Generative artificial intelligence (AI) is reshaping the music production industry, and it is also really challenging our traditional ideas about who creates and owns music when talking about copyright law. In China, the courts reckon that true originality comes from human creativity, so any works made entirely by AI are not formally recognized and protected. However, the United Kingdom and Hong Kong cases have taken a more pragmatic approach, where they treat the person who organizes the creation of an AI-generated work as the author. This difference reveals a deeper debate on whether we should keep the idea that creativity only comes from humans, or whether we could be flexible to keep up with new technology. This essay looks at how these two different paths impact authorship while using AI-generated contents in the music industry, and also considers how legal reforms and global standards could look like in the future.
