- Abstract
The entry into force of the Marrakesh Treaty marks a major shift in the international community’s approach to reshaping copyright rules with human rights jurisprudence and safeguarding the cultural rights of persons with disabilities. As the State Party with the largest visually impaired population in the world, China has not only undertaken the normative commitment of fulfilling its international obligations, but also faces the triple dilemma of conceptual cognitive bias, conflicting institutional adaptations, and insufficient technological empowerment. This paper takes “rights - system – technology” as the analytical framework, systematically deconstructs the real obstacles to the implementation of the treaty in China, and puts forward the integrated path of “conceptual innovation, rule reconstruction, and practice synergy”, aiming to contribute to the development of global intellectual property rights. It also proposes an integrated path of “conceptual innovation, rule restructuring, and practice synergy”, aiming to provide a Chinese experience for the balance between global intellectual property governance and human rights protection.
