Abstract

In the context of trial-centered reform of the criminal procedure system, there has long existed a structural imbalance in the procedure for disposing of property involved in a case, which is manifested in the lack of constraints on the expansion of investigative power in the pre-trial stage, the virtualization of court proceedings in the trial stage, and the poor implementation of remedies in the implementation stage after a judgment has been passed. In response to these problems, the revision of the Criminal Procedure Law should be used as an opportunity to improve the rule of law in the disposal of property involved in cases by constructing pre-trial constraints and supervision mechanisms, establishing a relatively independent court procedure for the trial of property, and improving the mechanism for the execution of property involved in cases, to raise the level of the rule of law in the disposal of property involved in cases, and to respond to the higher expectations of the people for the protection of human rights through the administration of justice.
