Abstract

Since the Enlightenment, Democracy and the Rule of Law have occupied the mainstream values of Western societies, becoming the most prominent characteristic and ultimate goal of political system modernization in various countries. In order to achieve China’s transition to modern democracy and rule of law, academic analysis and research on China’s power system, especially the party and government system, should focus on how China can realize the people’s sovereignty and comprehensive rule of law under the leadership of the Party, thereby achieving a higher level of democracy and rule of law. Based on this, when China undergoes its democratic and legal transformation, it must first clarify the necessity of upholding the overall leadership of the Party, and then explore how to establish a party-government system that is based on the coherence of the legal authority and responsibility, with each entity performing their respective functions, so as to ensure the rule of law for the exercise of state power. Along this path, contemporary China may find the key to addressing the significant issue of transitioning to democracy and the rule of law.
