Abstract

Halal certification is mandatory for products entering, circulating, and trading in Indonesia, and globally to protect the Muslim-majority population. However, some countries consider this a barrier to trade. This research seeks to examine the opportunities and challenges posed by halal certification requirements in the context of international trade, and to analyze the ways in which national legal frameworks align with the regulations of the World Trade Organization. This is a normative, prescriptive study using a legal and case-based approach, examining Indonesian regulations governing halal requirements and WTO rules, and then analyzed deductively through syllogism. Opportunities in international trade include halal certification obligations providing greater certainty in protecting Muslim consumers, becoming a choice for non-Muslim consumers from a health and hygiene perspective, enhancing competitiveness and added value for businesses, and broader access to international trade. The challenges can be seen as barriers to global trade, including complex systems, additional costs, and differing halal systems across countries. Harmonization and alignment of national and international laws are necessary to prevent disputes, through cooperation and mutual recognition with foreign halal institutional.
