Abstract

The agricultural sector is inseparable from natural risks and therefore always faces uncertainty. Indonesia has issued regulations on rice farming insurance (AUTP) with premium subsidies from the government. This program already exists in several countries, but programs in other countries are more innovative in providing legal protection to farmers. Indonesia still faces challenges in implementing AUTP, both from technical, sociological, and legal perspectives. This study will examine the comparison of agricultural insurance implementation in Indonesia with other countries and analyze recommendations for regulations that can be applied in Indonesia to ensure legal protection and address the implementation of the AUTP program to protect farmers’ rights. For this purpose, a comparison of agricultural insurance implementation in Indonesia with other countries will be conducted. The methods used are a doctrinal approach and comparative law. The research results indicate that Indonesia still faces technical, sociological, and legal challenges in implementing AUTP, resulting in low farmer interest in participating in this program. Therefore, the recommendations provided to Indonesia include the need to improve AUTP regulations to ensure legal protection of farmers’ rights, such as simplifying the claims process to provide benefits, determining fair compensation, and improving overlapping regulations regarding covered risks to ensure legal certainty.
