- Abstract
Good governance must be transparent, accountable, have a role of law and openness to information. Therefore, in the implementation of government, prioritize the needs of the community so that it can be effective and have an impact on those who need it. The ICT procurement program using Chromebook laptops cost Rp. 9,982,485,541,000. Presidential Decree No. 12 of 2021 concerning Government Procurement of Goods/Services was implemented using an e-catalog scheme without going through an auction process as stipulated in the laws and regulations, thus violating technical regulatory procedures, namely Presidential Decree No. 123 of 2020 concerning Technical Instructions for Physical DAK and Minister of Education and Culture Regulation No. 5 of 2021 concerning Operational Instructions for Regular Physical DAK in the Education Sector for the 2021 Fiscal Year. The administrative legal policy implemented was not based on data as found in the field and the technical team made another study to recommend using the chromebook. This has previously been tested using 1,000 Chromebook units by Pustekom Kemendikbudristek and the results were not effective for use and there was a technical team recommending not to use the Chromebook operation but to use the Windows Operating System (OS) but this was ignored. That this study aims to analyze the mega project in the procurement of educational digitalization in the form of Chromebook laptops by the Republic of Indonesia (Ministry of Education, Culture, Research, and Technology) in 2019–2023, as well as offering a reconstruction of policies based on good governance. That this type of research uses a normative juridical method of good governance analysis study approach to the administrative legal policy of Chromebook laptop procurement. This study was found to show no transparency, accountability, legal rules and orientation to consensus on the procurement of Chromebook laptops. The problem is the weak supervision that then besides the preparation, planning and arrangement that is not covered up so that public participation in the procurement of Chromebook laptops is less than optimal. That in the future, policies in administrative law to realize good governance require thorough preparation, good planning and effective drafting so that they will have an impact on public needs.
