Abstract

The COVID-19 brought a prompt shift to digital education mode at all education levels throughout the World which although a necessary action at that time also exposed critical gaps in educational equity and legal frameworks. This study employs a socio-legal lens to examine how the transition to online learning at a rapid scale induced by a pandemic affected marginalized communities, rural populations and low-income families due to inadequate access to technology, internet connectivity and digital literacy. Analyzing constitutional provisions, international human rights instruments and national education policies, the research identifies significant deficiencies in protecting the right to education during digital transformation. The research paper explores the violations of Article 21A and 14 of the Constitution of India while also dealing with the psychological and social impacts of remote learning methods, the resultant isolation and mental health issues. By evaluating the governmental and non-governmental responses taken to resolve the digital divide, this research paper aims to offer some recommendations that can aid in building up an inclusive infrastructure for digital education and emphasize on technology access that is universal with effective teacher preparedness and resource distribution of equitable nature to safeguard equality in educational rights in a world that is increasingly digitizing.
