Abstract

The widespread use of social media has revolutionised communication but has also amplified the associated risks. Digital defamation, being one of them, cuts through the heart of the conundrum of cyber space regulation and implementation of criminal laws in cyberspace. This paper examines the application of traditional laws of defamation in the digital sphere, considering jurisdictional challenges, platform liability, and the complexities introduced by user anonymity. An analysis of regulations from the USA, Anti-Defamation Act of the UK, and China’s position has been done to suggest a comprehensive model framework for India. Challenges relating to safe harbour provision, state-based misuse of the laws and potential violation of the fundamental right of freedom of speech and expression have been traced.
