- Abstract
Multinational Corporations (MNCs) often escape responsibility for human rights violations due to legal imbalances because them being backed by a strong international investment protection, in contrary to human rights enforcement that is too lenient to the point of viewed merely as advisory. Based on this issue, this study aims to examine the responsibility of MNCs for human rights violations through the perspective of the UN Guiding Principles on Business and Human Rights (UNGPs). Qualitative method was used through the analysis of UNGPs implementation in Indonesia, with regards to the Presidential Regulation No. 60 of 2023 regarding the National Strategies on Human Rights and Business. The results found that the enforcement of Human Rights in Indonesia remains a challenge despite the integration of the three pillars of the UNGPs into the domestic policies. In practice, it is also found that Corporate Social Responsibility (CSR) is limited to technical administrative sanctions rather than substantive reparations for affected communities. In conclusion, the transition from voluntary CSR to mandatory Human Rights Due Diligence (HRDD) is crucial to ensure effective access to reparations and bridge emerging governance gaps. The impact of this research is expected to provide theoretical contributions to the development of business and human rights law in Indonesia, as well as serve as a policy reference in strengthening regulations for the reparation of affected communities’ rights to create accountable justice in the investment sector.
