- Abstract
The growing human demand and ongoing technological progress have significantly fueled the expansion of the trade sector, particularly in intellectual property (IP). This expansion is evident in the sharp rise in IP registrations, which play a crucial role in the trade industry. As the number of trademark, copyright, patent, and industrial design registrations increases, so do intellectual property disputes. Historically, such conflicts have been settled in the Commercial Court. However, alternative methods like arbitration and mediation have become more widely embraced. The World Intellectual Property Organization (WIPO) manages the WIPO Mediation and Arbitration Center, a specialized platform for resolving IP disputes. Likewise, Indonesia has established its own institution, the Intellectual Property Arbitration and Mediation Agency (BAM HKI), since 2011, to address IP conflicts. In contrast to the Commercial Court, arbitration provides a more private, efficient, and faster means of resolving disputes, making it a more appealing option for the parties involved.
