- Abstract
This paper examines the responsibility of social media platforms concerning electronic-based sexual violence in Indonesia. Electronic-based sexual violence on social media is referred to as Electronic-Based Sexual Violence (“EBSV”). EBSV is a form of violence rooted in gender disparities, occurring within the digital realm. It significantly degrades the dignity of victims based on their gender or sexual attributes. Many victims of sexual violence are unaware of this form of abuse. Sexual violence often manifests persistently, with serious, traumatic consequences that can last a lifetime for the survivors. Electronic system organizers (“ESOs”), such as social media platforms, have taken measures to combat electronic-based sexual violence; however, EBSV continues to persist. Consequently, it is essential to consider imposing criminal liability on platforms that fail to prevent and address EBSV effectively. Research has yet to uncover norms and doctrines within Indonesian law that would allow for criminal accountability of these corporate electronic system organizers. Therefore, it is necessary to contemplate regulating the criminal liability of electronic system organizers for their failure to prevent EBSV.
