Abstract

The protection afforded to employees within a company through the Occupational Safety and Health Management System (OSHMS) serves as a preventive approach aimed at reducing workplace accidents and occupational illnesses. Ideally, every company should implement an effective OSHMS, and its provisions should be explicitly included in employment agreements, as occupational safety and health constitute fundamental labor rights that employers are obliged to uphold. The implementation of occupational safety and health standards is vital because it has a direct influence on employee performance, which in turn impacts the overall productivity and success of the company. However, in practice, some organizations have yet to establish a proper OSH management system. This study seeks to address three main issues: (1) how the regulations governing the Occupational Safety and Health Management System are harmonized within Indonesian legislation; (2) the mechanisms for supervision and legal protection of workers under the OSHMS framework; and (3) the extent to which the OSHMS has been effectively implemented in providing adequate protection to workers. This research adopts an empirical juridical approach, utilizing interviews and library research. Primary legal materials These comprise Law Number 1 of 1970 regarding Occupational Safety, Law Number 13 of 2003 concerning Manpower, and Government Regulation Number 50 of 2012 on the Implementation of the Occupational Safety and Health Management System, while secondary materials comprise scholarly works and related literature. The findings reveal that effective worker protection in the workplace can be achieved through a well-implemented OSHMS, which ultimately enhances employee productivity and contributes positively to overall company performance and outcomes.
