Abstract

The background of this research is the phenomenon of sending a baby’s corpse via online transportation services in Medan, which reveals a legal gap in the regulation of shipping sensitive items through digital platforms. Although regular shipping services are regulated, this case shows the need for clearer legal provisions regarding sensitive and illegal items. This study aims to analyze the legal regulations surrounding the shipping of sensitive items, particularly the transportation of a baby’s corpse via online transportation services, and to evaluate the implementation of existing laws in addressing technology-based crimes. The method used is a normative juridical approach with descriptive-analytical analysis, involving primary and secondary data through interviews and literature studies. The research findings indicate that the current legal regulations do not cover the shipment of sensitive items through digital platforms, and their implementation is still ineffective. The legal recommendations suggest the need for new regulations explicitly governing the shipment of sensitive items and stricter oversight of platforms and online transportation drivers. Swift and accurate law enforcement is also needed to prevent technology-based criminal acts.
