Abstract

Business Competition Supervisory Commission (KPPU) is an independent institution Which The Commission has a strategic role in upholding the principles of fair business competition and protecting consumers from monopolistic practices and unfair business competition. However, in practice, several KPPU decisions have been annulled by general courts, raising questions about legal certainty and the effectiveness of legal protection for consumers. This study aims to analyze the legal basis and legal consequences of the annulment of KPPU decisions, particularly in relation to consumer protection and business law principles. This research uses a normative juridical method with a legislative, conceptual, and case study approach to the court decision that overturned the KPPU decision. Data were analyzed qualitatively through a literature review and jurisprudence. Research shows that courts often overturn KPPU decisions based on procedural aspects or formal objections from business actors, without substantive consideration of the losses experienced by consumers. This indicates an imbalance between business interests and consumer protection. In the context of business law, this situation has the potential to undermine the principle of fair competition and reduce the effectiveness of KPPU oversight. This study recommends strengthening the legal standing of the KPPU before the courts, harmonization between Law No. 5 of 1999 and consumer protection regulations, and strengthening the judicial role in maintaining a balance between business interests and consumer rights.
