- Abstract
This study aims to analyze the legalization of the status of a child born out of wedlock within the Chinese ethnic community in Medan City as an effort to provide legal certainty, particularly in situations where one of the parents has passed away. The legalization is carried out through a late registration of marriage submitted by the surviving parent to the Civil Registry Officer, based on the ruling of the Medan District Court No. 196/Pdt.P/2024/PN Mdn.
Objective: To analyze the legalization of the status of a child born out of wedlock within the Chinese ethnic community in Medan City following a marriage legalization ruling.
Methods: The study examines the process of late marriage registration submitted by the surviving parent to the Civil Registry Officer and reviews the legal considerations of the Medan District Court Decision No. 196/Pdt.P/2024/PN Mdn used as the basis for child status legalization.
Results: The findings of this study indicate that the legal status of a child born out of wedlock can be transformed into that of a legitimate child, even when the marriage is registered after the death of one parent, provided that there is sufficient evidence of a biological relationship and acknowledgment from the family. Such legalization offers legal certainty that safeguards the child’s future rights, including inheritance, administrative identity, education, and other civil entitlements. Recognition as a legitimate child also ensures equal standing within the family and helps prevent legal and social discrimination.
Conclusion: This study underscores the essential role of court rulings in the process of legitimizing children born out of wedlock as a legal mechanism for protecting the rights of the child and promoting justice and equality.
