Abstract

This study analyzes the legal and practical problems related to the financing of visum et repertum for women in Indonesia who have experienced physical or sexual violence. A visum et repertum serves as essential forensic medical documentation used to support proof in legal cases criminal acts, particularly in cases of sexual violence. However, in practice, many victims face serious obstacles in obtaining this document due to the financial burden imposed upon them. Using With a normative juridical methodology and descriptive-analytical analysis as its basis, this research analyzes the legal framework governing visum et repertum costs, including Article 136 under the Indonesian Included in this framework are the Criminal Procedure Code; Law No. 31/2014 regarding Witness and Victim Protection; and Regulation No. 71/2013 issued by the Minister of Health, integrating forensic services under the National Health Insurance system. (JKN) system. framework. The findings reveal that although regulations normatively place the responsibility of visum et repertum financing on the state, the implementation remains ineffective and fragmented. Victims are often charged for visum issuance, resulting in inequality of access to justice, particularly among economically vulnerable groups. The study concludes that there is an urgent need to reconstruct Article 136 of the Criminal Procedure Code to explicitly mandate the state’s full responsibility for visum et repertum financing. Establishing an integrated mechanism between law enforcement agencies, health institutions, and administrative bodies is essential to ensure substantive justice and equal legal protection for all victims of crime.
