Abstract

The Maritime Code of the People’s Republic of China revised in 2025 introduces landmark legislative reforms to the actual carrier regime. It breaks the traditional identification criterion based on actual transport conduct, and classifies port operators who perform statutory cargo care obligations as actual carriers. This revision resolves a judicial predicament that has persisted for over three decades — the ambiguous legal status of port operators and the separation of rights and obligations between shipping and port sectors. It not only improves the jurisprudential framework of maritime private law, but also brings about profound managerial innovations in collaborative governance, risk control and compliance management for the shipping supply chain.

Based on the core revisions to Article 44 of the revised Maritime Code, this paper analyzes the institutional defects caused by the separated governance of shipping and port industries under the old law, expounds the jurisprudential rationale for expanding the scope of actual carriers to cover port operators, and explores how this institutional reform transforms the management models of shipping enterprises, port operators and maritime regulatory authorities. Targeting practical difficulties arising from the implementation of the new rules, this paper puts forward corresponding optimization strategies. It aims to provide theoretical support and practical references for the standardized, integrated and modern governance of China’s shipping supply chain.
