Research on the Protection Route of Video Games Rules

- Abstract
China’s vast video game industry faces inadequate protection for game rules due to the lack of relevant laws. Existing research primarily debates whether game rules constitute copyrightable expression, with less focus on specific protection methods. In response, this paper comparatively analyses the advantages and disadvantages of different protection modes to identify a more favourable approach. The study finds that copyright protection aligns better with the nature of game rules and proves more effective than non-copyright modes. Within the copyright protection mode, the separate protection mode has weak protection and difficult justification; the holistic protection mode has certain defects but can still be an effective protection mode after certain improvements; and the independent protection mode as part of a work represents the future direction as it can avoid the conceptual incompleteness in other protection modes. Since creating a new type of work for video games in copyright law cannot be completed in a short time, the protection of game rules at this stage still needs to rely on the holistic protection mode and gradually transitions to the independent protection mode.
