Protecting Children’s Personal Data: India & Beyond

Abstract

In the era of technological and digital advancement, there is a drastic transformation in the mode of interaction among children. With the emanation of plethora of digital platforms, they are highly exposed to bounteous risks online. There are reports from United Nations International Children Emergency Fund (UNICEF), Organisation for Economic Cooperation and Development (OECD) which substantiate that children are one of the vulnerable classes with respect to personal data breach. Instances like, in the case of Microsoft data breach of children through a platform named Xbox, elucidate that personal data of children in the digital domain remains highly vulnerable. All these incidents and several other instances called for the global attention in addressing this challenge. United States became the first country to enact a law for protection of children’s personal data namely Children’ in the year 1998 introducing the concept of verifiable consent. This also inspired other nations to join hands in addressing this challenge and was followed by “Personal Data Protection Act, 2012” of Singapore, “General Data Protection Regulation, 2016” of European Union etc. India also became part of those countries by enacting “Digital Personal Data Protection Act, 2023” (Digital Personal Data Protection Act, 2023), herein after mentioned as DPDP act3. All these legislations aim to provide procedural safeguards in the process of collecting, processing and storing personal data of children digitally. This research paper provides an in-depth analysis on child rights protecting personal data, key provisions of above - mentioned legislations and relevant case laws and comparatively examine the effectiveness of those legislation with that of India’s “Digital Personal Data Protection Act, 2023” and conclude by suggesting recommendations based on the comparative study for those areas which require further enhancement to make the act more stringent and to address the data breach of children effectively.
