- Abstract
We are living in the digital age wherein human efforts are getting replaced by machines. The growing dependency on technology is so much that this year’s theme on Consumer Rights Day was ‘Fair and Responsible AI for Consumers.’ The generative AI which captures consumer’s behavioural patterns and offers targeted recommendations has grown leaps and bounds. On one hand, this may seem to ease the consumers in this tech driven fast pace life and while on the flip side, this raises serious privacy concerns. Therefore, as Artificial Intelligence permeates the contours of consumer interaction and commerce, it becomes imperative to safeguard the rights of the consumers.
The research delves into the cross interface of AI and consumer protection with a focus on legal implications and challenges in the digital marketplace. The study also analyses the role of AI in back drop of the concerns pertaining to protection of digital personal data collected by such AI. To study the regulatory framework, consumer protection laws and AI compliances, the researcher has compared Indian legislative framework with that of EU.
It has been observed that India does not have any specific law on AI as the legal landscape on the subject matter is still evolving, however, there are other existing laws and regulations to address the concerns with regards to varied aspects of AI technology. The research highlights that there is a need to have harmonised regulatory framework and enhanced international cooperation to efficaciously protect the consumer rights in the digital age.
