- Abstract
The right to privacy and data protection is a fundamental human right, yet transgender inmates in Indian prisons face significant violations of these rights. This study examines the legal and human rights implications of data protection and privacy concerns for transgender individuals in the prison system. It highlights issues such as the unauthorized disclosure of gender identity, lack of confidentiality in medical records, and invasive surveillance practices that expose transgender inmates to discrimination and violence. The research critically analyzes existing legal frameworks, including the Transgender Persons (Protection of Rights) Act, 2019, the Digital Personal Data Protection Act, 2023, and international human rights standards, to assess their effectiveness in safeguarding the rights of transgender prisoners. The study underscores the urgent need for policy reforms to ensure the protection of sensitive data, uphold the dignity of transgender inmates, and align prison policies with constitutional and international human rights principles. It advocates for the adoption of comprehensive legal measures, enhanced institutional accountability, and the implementation of privacy-centric prison reforms to create a safer and more inclusive correctional environment.
