Abstract

Prisoners’ rights form an essential part of human rights discourse, emphasizing the dignity and legal safeguards afforded to incarcerated individuals. While imprisonment restricts liberty, it does not strip individuals of their fundamental human rights. This paper delves into the international and national perspectives on prisoners’ rights, exploring the obligations of states to uphold these rights under various legal frameworks, including the Universal Declaration of Human Rights, International Covenant on Civil and Political Rights, and national constitutions like those of India and South Africa. Despite legal safeguards, challenges such as overcrowding, inadequate healthcare, and ill-treatment persist within correctional institutions. The paper highlights judicial interventions that have shaped prisoner welfare and examines prison reform initiatives aimed at rehabilitation and reintegration. Recommendations include enhanced legal aid, vocational training, and improved healthcare access. The study underscores the need for a holistic approach that ensures humane treatment, aligning prison systems with evolving human rights standards. Ensuring the protection of prisoners’ rights not only promotes justice but also strengthens the social reintegration process, contributing to a more equitable legal system.
