Abstract

The rapid change in emerging technologies, such as blockchain and artificial intelligence (AI), has transformed the global supply chain and international trade. All these technologies promised enhanced efficiency, transparency and security in trade transactions. However, they also present legal and regulatory challenges. Blockchain technology improves transparency in supply chains by providing immutable transaction records. Where AI, through automation, predictive analysis and risk management, transforms AI. To ensure global compliance and address privacy concerns, data security and accountability, we need robust regulatory structures for the integration of these technologies. This paper examines the integration of blockchain & AI into global supply practices by focusing on specific issues such as cross-border recognition of digital contracts, liability, AI ethics and the legal framework governing these technologies.

The research highlights the role of the World Trade Organisation and the United Nations Commission on International Trade Law in adapting these new technologies. It also explores the potential impact of blockchain and AI on traditional supply chain models, which is affected by ongoing geopolitical shifts, digitalisation and sustainable business practices. The research methodology encompasses qualitative analysis by conducting interviews and surveys with industry experts. Case studies will be done on cases such as Securities and Exchange Commission v. Telegram Group Inc, 2020, which addresses the regulatory challenges of digital assets and blockchain technology, and the CIMB Bank Berhad v. Tan Sri Dato’ Sri Lodin Wok Kamaruddin, 2020 case, which highlights issues related to smart contracts in Malaysia. This paper aims to provide solutions for the legal complexities given by emerging technologies.
