- Abstract
Generative AI, exemplified by ChatGPT, has greatly improved people's daily lives while simultaneously giving rise to a range of legal challenges. This paper focuses on the legal issues surrounding ChatGPT, particularly in the protection of personal information, and explores possible adaptation paths. Due to the lagging nature of current laws and regulations, ChatGPT still faces significant compliance risks in various aspects, including data collection, processing, and ensuring users’ right to informed consent. This paper first outlines the data collection mechanisms of ChatGPT and evaluates the associated legal risks, such as unauthorized data crawling, potential information leakage, and the lack of effective implementation of the informed-consent principle. Furthermore, it explores issues related to accountability when AI-generated content inadvertently leads to data breaches. Lastly, this paper discusses the legal challenges of generative AI in personal information protection within the existing legal framework and proposes feasible adaptation strategies to enhance the protection of users’ data rights and privacy.
