- Abstract
Traditionally human authorship is recognized by national copyright legislations and international instruments like Berne Convention, TRIPS Agreement, etc. The notion is now challenged by the advent of Artificial Intelligence. Artificial Intelligence is playing a pivotal role in predicting protein structure with atomic precision and genetic sequences that are improvising modern crop science as well as agricultural biotechnology. These AI generated outputs generated falls into ownership vacuum of human-authorship requirements.
The paper discusses the doctrinal criticism of the existing international framework dealing with copyright protection and Indian Copyright Act, 1957, while elaborating with judicial pronouncement across the globe on copyright protection to exclusion of AI generated scientific outputs. The research also incorporates an empirical study of agri-biotech researchers, policy makers, lawyers on the global practices and how a possible solution to the AI-human generated outputs. The research paper also proposes a framework for a new multilateral instruments that can incorporate innovation incentives with the new age technology.
