- Abstract
Crises such as pandemics, economic shocks, and natural disasters often disrupt business operations and create legal uncertainty in employment relationships. Employers may invoke force majeure to suspend, modify, or terminate employment obligations, while workers remain entitled to wage security, fair treatment, and legal protection. This article examines the legal position of force majeure in employment contracts and its implications for balancing business continuity with workers’ rights protection. The study employs normative juridical research using statutory, conceptual, and case-based approaches, supported by analysis of labor regulations, contract law principles, and relevant legal doctrines. The findings indicate that force majeure cannot be used automatically to release employers from employment obligations. Its application must be assessed carefully based on unforeseeability, causality, impossibility of performance, good faith, proportionality, and compliance with labor protection norms. The article concludes that crisis management in employment contracts requires a balanced legal framework that safeguards business survival without undermining workers’ fundamental rights.
